DISCLAIMER:

This survey report is intended for the Client use only and represents our interpretation of the findings of our visual, non-destructive and superficial inspection on board the vessel carried out on the stated dates only. This inspection was carried out to the best of our knowledge and ability and the report is issued without prejudice to the interests of any party. The opinions expressed are given in good faith as to the condition of the vessel as seen at the time of the survey. Anyone wishing to rely on such an opinion should first satisfy himself as to its accuracy and feasibility. It implies no guarantee, no safeguard against latent defects, subsequent defects, or defects not discovered at the time of the survey in woodwork or areas of the vessel which are covered, unexposed, or not accessible to the surveyor internally due to the installation of non-removable linings, panels and internal structures etc., or agreement and permission and instructions not being given to the surveyor to gain access to closed off areas. No machinery was opened unless stated.

Neither OceanPro Boat Inspections WA or its Owner/Director, David Nunn, shall be held liable by the Client for any error of judgement or omission of facts. The survey and report were conducted in accordance with our standard terms and conditions.

GENERAL TERMS / LIABILITY & LIMITATIONS:

1. The Client acknowledges that while OceanPro Boat Inspections WA utilizes accepted methods for fault detection, these methods do not guarantee the identification of all vessel faults.

2. The Company shall be under no liability whatsoever to the Client for any loss, damage, delay or expenses of whatsoever nature whether direct or indirect (including but not limited to loss of profit) and however arising in the course of performance of the services to be provided. UNLESS same is proved to have resulted solely from the negligence, gross negligence or willful default of the Company or their employees or agents, or sub-contractors employed by them in connection with the ship, in which case (save where loss, damage, delay or expense has resulted from the Company’s personal act or omission committed with the intent to cause same or recklessly and with knowledge that such loss, damage, delay or expense would probably result) the Company’s liability for each incident or series of incidents giving rise to a claim or claims shall never exceed a total of AUD $2,000 (two thousand Australian dollars).

3. Except to the extent and solely for the amount therein set out that the Company would be liable, the Client hereby undertakes to keep the Company and their employees, agents and sub-contractors indemnified and to hold them harmless against all actions, proceedings, claims, demands or liabilities whatsoever or howsoever arising which may be brought against them or incurred or suffered by them arising out of or in connection with the performance of the agreement, and against and in respect of all costs, loss, damages and expenses (including legal costs and expenses on a full indemnity basis) which the Company may suffer or incur (either directly or indirectly) in the course of the performance of this agreement.

4. This report carries no warranty regarding ownership of the vessel or any warranty regarding outstanding mortgage, charge or other debt there may be on the vessel.

5. This report does not address stability, vessel performance or overall design, and no warranty is conveyed under these heads.

6. Only engines with unrestricted access to spark plugs, which are those that don’t require the removal of external parts or the use of any specialized tools, may undergo compression testing. Spark plug condition analysis is a general analysis and should not be used as a substitute for expert guidance. Instead, you should show the inspection report images to qualified spark plug agents or specialists. Oil samples analysis tests are recommended to be carried out by a mechanic on all second hand engines.

7. Accurate moisture testing can only be conducted after a minimum of 4 days of any vessel being kept completely dry and out of the water. The Company uses Tramax Skipper 5 moisture meter which is industry standard and will be used precisely as per the Tramax User Guide link: smm5-skipper-5-user-guide.pdf (tramexmeters.com)<https://tramexmeters.com/perch/resources/downloads/user-guides/smm5-skipper-5-user-guide.pdf>. Any timber or plywood covered with fiberglass is NOT included in this inspection – including transom moisture/condition.

8. Electricals are tested generally for power-on ability only, not functionality. 240 volt wiring or installations are NOT included. Contacts and connections will not be individually tested for condition or resistance.

9. Depending on the vessel’s location, travel fees may be necessary for inspection services. These expenses will be computed appropriately.

10. If severe weather conditions such as heavy rain or extreme heat occur, or if OH&S deems it impractical for an extended period, the inspection may be rescheduled.

12. This report is provided subject to the defects listed in the Report. If The Client chooses to take the vessel out to sea, it is at their own risk.

13. THIS IS NOT A SEAWORTHINESS CERTIFICATE.
